REVITA Terms of Service

Welcome to REVITA ("we," "us," "our," or "Company"), a smart agriculture platform service provided by REVITA, Inc., located in Seoul, South Korea. These Terms of Service ("Terms") govern your access to and use of our website, application, IoT devices, and services (collectively, the "Service"). By accessing or using the Service, you ("you," "user," or "your") agree to be bound by these Terms, our Privacy Policy (incorporated herein by reference), and any additional guidelines or rules we may post.

If you do not agree to these Terms, do not use the Service. We may update these Terms from time to time; continued use after changes constitutes acceptance. We will notify you of material changes via email or in-app notice.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to use the Service. By using the Service, you represent that you meet these requirements and are not barred from using similar services under applicable laws. You are responsible for complying with all applicable laws.

2. Account Registration and Security

To use the Service, you must create an account. You agree to provide accurate information and maintain the confidentiality of your account credentials. You are responsible for all activities under your account. Notify us immediately of any unauthorized access at sanghyeokum@revita.kr. We may suspend or terminate accounts for security reasons or violations of these Terms.

3. Service Description and Features

REVITA provides a smart agriculture platform that includes:

  • IoT-based farm monitoring through REVITA Tower devices (sensors for temperature, humidity, soil moisture, light, multispectral imaging).
  • AI-powered crop health analysis and farming recommendations.
  • Remote farm monitoring via mobile and web applications.
  • Automated farming diary and irrigation management.
  • Wildlife detection and deterrence systems.
  • Free tier with subscription upgrades for advanced features.

We use third-party services for processing and hosting. Availability is not guaranteed; we may modify or discontinue features at any time.

4. User Content and Licenses

a. Your Content

You may upload farm data, images, and other content ("User Content"). You retain ownership of your User Content, but grant us a worldwide, non-exclusive, royalty-free license to use, store, process, reproduce, and display it as necessary to provide the Service, including generating analytics and reports. This license ends when you delete your content or account, except for retained copies for legal/compliance purposes.

b. Representations and Warranties

By uploading User Content, you represent and warrant that:

  • You own or have all necessary rights and permissions to use and share the content.
  • The content does not infringe third-party rights or violate any laws.
  • The content will not be used for deceptive, harmful, or illegal purposes.

5. Prohibited Conduct

You agree not to:

  • Use the Service for any illegal or unauthorized purpose.
  • Attempt to reverse engineer, decompile, or disassemble the Service or devices.
  • Interfere with or disrupt the Service or servers.
  • Access data not intended for you or log into a server/account you are not authorized to access.
  • Modify, tamper with, or damage REVITA Tower devices or related hardware.

6. AI Usage and Data Training

We use anonymized or aggregated farm data for AI model training to improve our crop analysis and farming recommendation features. We do not use individually identifiable data for training unless you explicitly consent. You acknowledge AI outputs may not always be accurate or error-free.

7. Intellectual Property

The Service, including AI models, software, hardware designs, and branding, is owned by us or our licensors. You receive a limited, revocable license to use the Service for its intended purpose. Do not copy, modify, or distribute our intellectual property without permission.

8. Monitoring, Termination, and Suspension

We reserve the right to monitor usage for compliance, remove content, suspend/terminate accounts, or restrict access for violations, legal requirements, or at our discretion. Upon termination, your license ends, and we may delete your data.

9. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES, EXPRESS OR IMPLIED (INCLUDING MERCHANTABILITY OR FITNESS FOR PURPOSE). WE DISCLAIM LIABILITY FOR AI OUTPUT ACCURACY, SENSOR DATA RELIABILITY, OR THIRD-PARTY ACTIONS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED AMOUNTS PAID BY YOU IN THE PRIOR 12 MONTHS.

REVITA Tower devices provide data for informational purposes only. Farming decisions based on this data are made at your own risk.

10. Indemnification

You agree to indemnify, defend, and hold us harmless from any claims, losses, or expenses (including attorneys' fees) arising from:

  • Your use of the Service or devices.
  • Violations of these Terms or applicable laws.
  • Your User Content.

11. Dispute Resolution and Governing Law

These Terms are governed by the laws of the Republic of Korea. Any disputes shall be resolved exclusively in courts located in Seoul, South Korea. We encourage informal resolution first via sanghyeokum@revita.kr.

12. Miscellaneous

  • Entire Agreement: These Terms, plus our Privacy Policy, constitute the full agreement.
  • Assignment: We may assign these Terms; you may not without consent.
  • No Waiver: Failure to enforce does not waive rights.
  • Severability: If any provision is invalid, the rest remain enforceable.

We may update these Terms; check periodically. Material changes will be notified via email or in-app notice.
